Terms of Service

1. Agreement to Terms

By accessing or using the ServiceTrove platform operated by Service Trove LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

These Terms apply to all users of the platform, including business owners ("Owners"), service providers ("Providers"), and customers booking services ("Clients").

2. Description of Service

ServiceTrove provides a software-as-a-service (SaaS) platform that enables service-based businesses to:

  • Create and manage Progressive Web Apps (PWAs) for their business
  • Accept online bookings and appointments
  • Process payments through integrated payment systems
  • Manage team members and schedules
  • Communicate with clients via notifications
  • Access AI-powered business assistant features

2.1 AI-Powered Assistant Features

ServiceTrove includes an AI-powered business assistant that may provide suggestions, recommendations, generated content, analytics insights, and other automated outputs ("AI Outputs"). By using these features, you acknowledge and agree to the following:

  • Informational Only: AI Outputs are provided for informational and assistive purposes only. They do not constitute professional, legal, financial, medical, or any other form of licensed advice
  • No Guarantee of Accuracy: AI Outputs may be inaccurate, incomplete, outdated, or inappropriate for your specific situation. We do not warrant the accuracy, reliability, completeness, or suitability of any AI-generated content
  • Your Responsibility: You are solely responsible for reviewing, verifying, and validating any AI Output before relying on it or sharing it with others. Any decisions you make based on AI Outputs are made at your own risk
  • Not a Substitute for Professional Judgment: AI features are assistive tools and are not a replacement for qualified professional advice. You should consult with appropriate professionals for business, legal, tax, or regulatory matters
  • Third-Party AI Providers: Our AI features may be powered by third-party services (e.g., Google, OpenAI, Anthropic). Your use of AI features is also subject to the applicable terms and policies of these providers. We are not responsible for the outputs, availability, or performance of third-party AI systems
  • No Liability for AI Outputs: To the maximum extent permitted by law, Service Trove LLC is not liable for any damages, losses, or consequences arising from your use of or reliance on AI Outputs, including but not limited to business decisions, content published, or actions taken based on AI-generated suggestions

2.2 Voice & Text-to-Speech Features

ServiceTrove may include voice-enabled features such as voice commands, voice-to-text input, and text-to-speech output (collectively, "Voice Features"). By using Voice Features, you acknowledge and agree to the following:

  • Voice Data Processing: When you use Voice Features, your voice input may be captured, processed, and transmitted to third-party speech recognition and synthesis services (e.g., Google Cloud, browser APIs) for processing. We do not permanently store raw voice recordings unless explicitly stated
  • Automatic Listening on Page Open: When you open the AI assistant, the microphone may automatically activate for a brief period (approximately 5 seconds) to listen for voice commands. If the assistant is launched via a third-party voice assistant (e.g., Siri, Google Assistant), this listening window may be extended up to 30 seconds. During this time, ambient audio from your microphone is processed by the browser's speech recognition engine. If no speech is detected, listening stops automatically. By navigating to the AI assistant page, you consent to this automatic microphone activation
  • Consent to Recording: By activating any Voice Feature or navigating to a voice-enabled page, you consent to the capture and processing of your voice input for the purpose of providing the requested functionality. You are responsible for informing and obtaining consent from any other individuals whose voices may be captured while using Voice Features
  • Accuracy Limitations: Voice recognition and text-to-speech outputs may contain errors, misinterpretations, or inaccuracies. You are responsible for reviewing and verifying any actions taken or content generated through Voice Features
  • No Liability: We are not liable for any errors, misinterpretations, unintended actions, or consequences resulting from the use of Voice Features, including incorrect voice commands that trigger bookings, messages, or other platform actions

We reserve the right to modify, suspend, or discontinue AI and Voice features at any time without notice.

2.3 Push Notifications

ServiceTrove may send push notifications to your browser or device with your permission. These notifications may include:

  • Booking confirmations, reminders, and schedule updates
  • Payment notifications and billing alerts
  • Platform updates and service announcements
  • Team activity and staff updates (for business owners)

Push notifications require your explicit browser permission and can be disabled at any time through your browser settings or notification preferences in your account. We are not liable for missed notifications due to browser settings, device configurations, network issues, or any other factors outside our control.

2.4 Guest Bookings

The platform allows clients to book services without creating an account ("Guest Bookings"). Guests provide limited information (such as name, email, and phone number) solely for booking fulfillment purposes. Guest booking data is governed by both this Privacy Policy and the business owner's own privacy practices. Guest users do not have access to account features such as booking history, preferences, or saved payment methods. By making a guest booking, you agree to these Terms and our Privacy Policy.

2.5 Waitlist

Some businesses on the platform may offer a waitlist feature. By joining a waitlist, you provide your name, contact information, and service preferences. Placement on a waitlist does not guarantee an appointment or service availability. The business owner manages the waitlist at their discretion. Waitlist data is retained per our data retention policy and may be removed by the business owner at any time.

2.6 Support Services

ServiceTrove provides customer support on a reasonable-efforts basis. We do not guarantee specific response times or resolution outcomes. Support communications may be retained for quality assurance, training, and dispute resolution purposes. For support inquiries, contact support@servicetrove.com.

Administrative access. To provide support, troubleshoot issues, or assist with setting up your account (for example, configuring your domain or DNS), authorized ServiceTrove personnel may access and make configuration changes within your account. Such access is limited to support purposes, is logged and auditable, and does not include making payments, changing your billing or subscription, or entering any financial commitment on your behalf. Configuration changes made by our personnel at your request or to keep the service working are treated as authorized account activity.

3. Account Registration & Age Requirement

To use our services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

YOU MUST BE AT LEAST 18 YEARS OLD TO CREATE AN ACCOUNT, ACCESS, OR USE THE SERVICETROVE PLATFORM IN ANY CAPACITY. By registering, you represent and warrant that you are at least 18 years of age, that you have the legal capacity to enter into these Terms, and that all registration information you provide is truthful and accurate.

If we discover or have reason to believe that an account holder is under 18 years of age, we will immediately suspend or terminate the account without notice and delete all associated data. We reserve the right to require proof of age at any time.

If a parent or legal guardian becomes aware that their minor child has created an account or provided personal information without their consent, they should contact us immediately at legal@servicetrove.com. Parents or guardians may be held responsible for any damages or liabilities arising from a minor's unauthorized use of the platform.

4. Subscription and Payment

ServiceTrove offers subscription-based pricing. Current pricing and features are available on our website. By subscribing, you authorize us to charge your payment method on a recurring basis.

Free Trial: New accounts receive a 7-day free trial with access to core platform features. At the end of the trial period, a 1-day grace period may be provided before your account is restricted. If no paid subscription is activated after the grace period, your account functionality will be limited until payment is made. You are under no obligation to subscribe after the trial. Trial features may differ from paid plan features, and certain add-ons (e.g., AI Assistant, additional team seats) may require separate payment. We reserve the right to modify trial duration, features, and terms at any time without prior notice.

Platform Fees: We charge a small percentage fee on transactions processed through our payment system. Current fee rates are disclosed during setup.

Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period.

Pricing Changes: We reserve the right to modify our subscription prices, platform fees, and fee structures at any time. We will provide at least 30 days' advance notice of any price increases by email or through the platform. Your continued use of the service after a price change takes effect constitutes your acceptance of the new pricing. If you do not agree with a price change, you may cancel your subscription before the new pricing takes effect.

5. Payment Processing

Payment processing is provided by Stripe, Inc. By using our payment features, you also agree to Stripe's Terms of Service.

Business owners using Stripe Connect to accept payments must complete Stripe's verification requirements. We are not responsible for payment disputes between you and your clients.

Stripe Is a Separate System: Stripe operates as an independent third-party payment processor. Your Stripe account, payment data, card information, bank account details, and payout history are managed entirely by Stripe under their own terms, privacy policy, and security practices. ServiceTrove does not store, access, or control your full payment card numbers, bank account credentials, or Stripe account passwords. We receive only transaction confirmations and payment status information from Stripe. Any issues related to payment processing, chargebacks, payouts, Stripe account freezes, or Stripe verification requirements are between you and Stripe. We are not liable for any loss, delay, or error arising from Stripe's systems, policies, or actions.

6. Referral Program

ServiceTrove may offer a referral program that allows users to earn account credits by referring new businesses to the platform. By participating in the referral program, you agree to the following:

  • Credits: Referral credits are applied to your ServiceTrove account balance and may only be used toward platform subscription fees. Credits are non-transferable, non-refundable, and have no cash value
  • Limits: The maximum number of active referrals, credit amounts, and expiration periods are determined by us and are subject to change at any time. Currently, credits expire 30 days after issuance
  • Qualification: Referral credits are typically earned when a referred business makes their first paid subscription payment. We determine qualification at our sole discretion
  • Fraud & Abuse: Any attempt to abuse, manipulate, or game the referral program — including creating fake accounts, self-referrals, or using automated methods — will result in immediate disqualification, forfeiture of all credits, and potential account termination
  • Program Changes: We reserve the right to modify, suspend, or terminate the referral program, change credit amounts, or alter eligibility requirements at any time without prior notice

7. Acceptable Use & Prohibited Activities

You are solely responsible for all content you post, services you list, and activities you conduct through the platform. You agree not to use ServiceTrove for any purpose that is illegal, harmful, or prohibited by these Terms. Specifically, you agree not to:

7.1 Illegal & Harmful Activities

  • Use the platform to facilitate, promote, or engage in any illegal activity under local, state, federal, or international law
  • List, advertise, or provide services that are illegal or require licenses or permits you do not possess
  • Facilitate money laundering, terrorist financing, or any other financial crime
  • Use the platform to facilitate drug trafficking, human trafficking, or exploitation of any kind
  • Engage in fraud, deception, or misrepresentation of any kind, including creating fake bookings, reviews, or identities
  • Use the platform to harass, threaten, stalk, intimidate, or harm any person
  • Post or transmit content that is defamatory, obscene, abusive, or that promotes violence or discrimination

7.2 Exploitation & Abuse of Minors

  • Any content, services, or conduct that exploits, harms, or endangers minors is strictly prohibited and will result in immediate account termination and reporting to law enforcement
  • You may not use the platform to contact, solicit, or communicate with minors for any inappropriate purpose
  • If your listed services involve minors (e.g., tutoring, childcare), you represent that you comply with all applicable background check requirements, licensing laws, and child protection regulations in your jurisdiction

7.3 Platform Integrity

  • Violate the intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with other users' use of the service
  • Use the service to send spam or unsolicited communications
  • Misrepresent your identity, qualifications, or affiliation
  • Resell, sublicense, or redistribute the service without authorization
  • Scrape, data mine, or use automated tools to extract data from the platform
  • Circumvent or attempt to circumvent any security, rate-limiting, or access controls
  • Copy, clone, reverse engineer, or create derivative works of the platform or any part thereof (see Section 10 for details)
  • Access the platform for the purpose of building a competing or substantially similar product or service

7.4 Unauthorized Access & Cybersecurity

Any attempt to gain unauthorized access to the ServiceTrove platform, its servers, databases, networks, or any associated systems is strictly prohibited and may violate applicable federal and state laws, including but not limited to the Computer Fraud and Abuse Act (18 U.S.C. § 1030), the Electronic Communications Privacy Act, and equivalent state laws. Specifically, you agree not to:

  • Access or attempt to access any account, system, network, or data that you are not authorized to access
  • Probe, scan, or test the vulnerability of the platform or any associated system or network, or breach any security or authentication measures
  • Exploit any bug, vulnerability, or security flaw, whether known or unknown, for any purpose (if you discover a vulnerability, you must report it to security@servicetrove.com immediately)
  • Introduce or deploy any virus, worm, trojan horse, ransomware, spyware, adware, keylogger, rootkit, or other malicious software or code
  • Conduct denial-of-service (DoS), distributed denial-of-service (DDoS), or any attack intended to disrupt, degrade, or disable the platform
  • Intercept, monitor, or capture data or communications not intended for you, including through man-in-the-middle attacks, packet sniffing, or session hijacking
  • Use brute force, credential stuffing, password spraying, or any automated method to attempt to gain access to accounts
  • Forge headers, spoof IP addresses, or manipulate identifiers to disguise the origin of any communication sent through the platform
  • Access or attempt to access other users' personal data, payment information, or account credentials

VIOLATIONS WILL BE PROSECUTED. We will investigate suspected violations and cooperate fully with law enforcement authorities in prosecuting users who violate this section. Violators may be subject to civil and criminal penalties, including imprisonment and fines under the Computer Fraud and Abuse Act and other applicable laws.

We reserve the right to immediately suspend or terminate any account involved in or suspected of unauthorized access, and to preserve and disclose all relevant data to law enforcement without prior notice to the user.

7.5 Account Security Responsibility

You are solely responsible for maintaining the security of your account credentials, including your password and any authentication tokens. You agree to:

  • Use a strong, unique password that you do not reuse from other services
  • Keep your login credentials confidential and not share them with any third party
  • Immediately notify us at security@servicetrove.com if you suspect any unauthorized access to or use of your account
  • Log out of your account when using shared or public devices

You are liable for all activity that occurs under your account, whether or not authorized by you. We are not responsible for any loss or damage arising from your failure to maintain the confidentiality of your account credentials. If unauthorized access occurs due to your negligence (e.g., sharing credentials, weak passwords, falling for phishing), you remain fully responsible for any resulting actions or damages.

Unauthorized Access with Valid Credentials: If a third party gains access to your account using valid login credentials (e.g., through credential theft, phishing, data breaches on other platforms where you reused passwords, or unauthorized access to your device), Service Trove LLC is not liable for any actions taken, data accessed, bookings made or cancelled, payments processed, or other consequences resulting from that access. A login performed with correct credentials is treated as an authorized login. It is your sole responsibility to secure your credentials and devices.

8. User Responsibility & Compliance

You are solely responsible for ensuring that the services you offer through the platform comply with all applicable laws, regulations, and licensing requirements in your jurisdiction. ServiceTrove is a technology platform only and does not verify, endorse, or guarantee the legality, quality, safety, or suitability of any services listed by users.

Business owners who use the platform to accept bookings and payments represent and warrant that:

  • They hold all necessary licenses, permits, and certifications required to offer their services
  • They comply with all applicable local, state, federal, and international laws and regulations
  • They maintain appropriate insurance coverage for the services they provide
  • They are responsible for collecting and remitting any applicable taxes
  • They will not use the platform to facilitate any illegal or prohibited services

Verification & Documentation: We reserve the right to request, at any time and at our sole discretion, proof of identity, business registration, professional licenses, permits, insurance certificates, or any other documentation we deem necessary to verify your eligibility to use the platform or the legitimacy of the services you offer. Failure to provide requested documentation within a reasonable timeframe (typically 14 days) may result in suspension or termination of your account and hosted site.

By creating an account, you confirm and represent that: (a) you are at least 18 years of age; (b) all information you provide is accurate, current, and complete; (c) you are authorized to operate the business you register; (d) you will promptly update your information if any details change; and (e) you will provide and maintain a valid physical mailing address associated with your business. A valid mailing address is required for account verification, legal notices, regulatory compliance, and communication purposes. P.O. boxes alone are not sufficient; a street address is required.

8.1 Hosted Sites, Subdomains & Custom Domains

ServiceTrove provides business owners the ability to create hosted sites accessible via ServiceTrove subdomains (e.g., yourbusiness.servicetrove.com) or custom domains configured by the owner. By creating and operating a hosted site, you acknowledge and agree to the following:

  • Content Responsibility: You are solely responsible for all content displayed on your hosted site, including business descriptions, images, service listings, pricing, and any other materials. Your site must comply with all applicable laws, these Terms, and our Acceptable Use policies at all times
  • Legal Compliance: Your hosted site must comply with all applicable laws and regulations in every jurisdiction where your site is accessible or where you provide services, including but not limited to consumer protection laws, advertising standards, professional licensing requirements, accessibility standards, and data protection regulations (e.g., GDPR, CCPA)
  • Your Own Privacy Policy: If you collect personal information from your clients through your hosted site (e.g., via bookings, contact forms), you are responsible for maintaining your own privacy policy that complies with applicable data protection laws and accurately describes your data practices
  • Prohibited Content: Your hosted site may not contain or promote illegal services, discriminatory practices, misleading or deceptive claims, counterfeit goods, adult content, gambling, or any content that violates these Terms
  • Domain Ownership: If you connect a custom domain, you represent that you own or have authorization to use that domain. We are not responsible for domain registration, renewal, DNS issues, or disputes related to domain ownership
  • Domain Purchases & Transfers: Domains purchased or transferred through ServiceTrove are non-refundable. You are solely responsible for domain renewal and maintaining valid registration. Domain transfers out of the platform are available in accordance with ICANN rules. WHOIS privacy may be applied where available. We are not liable for domain disputes with third-party registrars, ICANN, or other domain authorities

8.2 Team Members & Service Providers

Business owners may invite team members and service providers to their account. By using the team management features, you acknowledge and agree to the following:

  • Independent Relationship: Team members and service providers added to the platform are not employees, agents, or representatives of Service Trove LLC. ServiceTrove is not an employer and bears no responsibility for the relationship between business owners and their team members
  • Owner Responsibility: Business owners are solely responsible for ensuring that their team members and providers comply with these Terms, all applicable laws, and any professional licensing or certification requirements
  • Provider Payments: Providers may be required to set up Stripe Connect accounts to receive payouts. Provider payment terms, including payout schedules and disputes, are between the provider, the business owner, and Stripe
  • Data Sharing: Team members' data (name, email, schedule, role) is shared with the business owner who invited them. By accepting a team invitation, providers consent to this data sharing
  • Removal: Business owners may remove team members at any time. Removed team members lose access to the business account but retain any personal account data

8.3 Right to Restrict, Suspend, or Remove Sites

WE RESERVE THE RIGHT TO RESTRICT, SUSPEND, DISABLE, OR PERMANENTLY REMOVE ANY HOSTED SITE AT ANY TIME, WITH OR WITHOUT PRIOR NOTICE, AT OUR SOLE DISCRETION. This includes, but is not limited to, the following circumstances:

  • The site contains content that violates these Terms, our Acceptable Use policies, or any applicable law
  • We receive a valid complaint, legal notice, takedown request, or court order related to the site's content or operation
  • We detect or reasonably suspect illegal activity, fraud, scams, or deceptive practices being conducted through the site
  • The site is being used to exploit, harm, or endanger any person, including minors
  • The site poses a security threat to the platform, other users, or the public (e.g., malware distribution, phishing)
  • The site is generating excessive complaints, chargebacks, or disputes
  • The associated account is in violation of these Terms or has been terminated
  • For any other reason we deem necessary to protect the platform, its users, or our reputation

If we identify threats, illegal activity, or Terms violations on your hosted site, we will take immediate action, which may include any combination of: disabling public access to your site, suspending your account, preserving evidence, reporting the activity to law enforcement, and permanently deleting the site and all associated data. We are under no obligation to provide advance notice before taking action, and you will not be entitled to any refund for the affected billing period.

You agree that ServiceTrove bears no liability for any losses, damages, or disruption to your business resulting from the restriction, suspension, or removal of your hosted site under this section.

9. Monitoring, Reporting & Law Enforcement

We reserve the right, but are not obligated, to monitor, review, and investigate any content, activity, or conduct on the platform. We may take any action we deem appropriate in response to violations of these Terms, including but not limited to:

  • Removing or disabling access to content that violates these Terms
  • Suspending or terminating user accounts without prior notice
  • Reporting illegal activities or content to appropriate law enforcement authorities
  • Cooperating with law enforcement investigations, including disclosing user information as required by law or valid legal process
  • Preserving account data and activity logs for use in legal proceedings

We will cooperate fully with law enforcement authorities and comply with court orders requesting or directing us to disclose the identity, activity records, or other information of any user suspected of engaging in illegal activity.

If you become aware of any illegal activity, exploitation, abuse, or Terms violation on the platform, you are encouraged to report it immediately to legal@servicetrove.com.

9.1 Automated Processing & Notifications

ServiceTrove uses automated systems to provide certain platform functions, including but not limited to:

  • Automated appointment reminders via push notification and email
  • Automated trial expiration processing and account restriction
  • Automated no-show detection and marking
  • Automated booking confirmation and payment processing
  • Scheduled data backups and maintenance operations

We do not guarantee the timing, delivery, or accuracy of automated notifications. We are not liable for missed appointments, lost revenue, or other consequences resulting from failed or delayed automated notifications. No fully automated decisions with significant legal effects are made without the opportunity for human review.

10. Intellectual Property & Platform Protection

The ServiceTrove platform, including but not limited to all software, source code, object code, algorithms, APIs, database schemas, user interface designs, layouts, visual elements, text, graphics, logos, icons, workflows, business logic, and documentation, is the exclusive property of Service Trove LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

10.1 User-Uploaded Content & License Grant

You retain ownership of content you upload to the platform (including but not limited to photos, logos, business descriptions, service listings, and other materials). However, by uploading, posting, or submitting any content to ServiceTrove, you grant Service Trove LLC a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works of such content for the following purposes:

  • Providing, operating, and improving the ServiceTrove platform and services
  • Displaying your business profile, services, and content to potential clients through your PWA and our platform
  • Marketing and promoting ServiceTrove (e.g., featuring your business as a case study, in promotional materials, or on social media), unless you opt out by contacting us
  • Generating aggregated, anonymized, or de-identified analytics and insights
  • Training and improving our AI-powered features using aggregated and de-identified data
  • Complying with legal obligations, including responding to law enforcement requests
  • Creating backups and ensuring platform reliability

This license continues for as long as your content remains on the platform and for a reasonable period after deletion to account for backups, caches, and legal retention requirements. You may request deletion of your content at any time, and we will remove it within 90 days, subject to legal retention obligations.

You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload all content you submit, and that your content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, or any applicable law. You are solely responsible for any content you upload and any consequences of sharing it.

We reserve the right to remove any content that violates these Terms, is illegal, or is otherwise objectionable, at our sole discretion and without prior notice.

10.2 Prohibited Copying & Reverse Engineering

You expressly agree that you will NOT, directly or indirectly:

  • Copy, reproduce, duplicate, clone, replicate, or imitate the ServiceTrove platform, or any substantial part thereof, including its design, layout, features, functionality, user interface, user experience, or workflows
  • Reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive the source code, underlying algorithms, data structures, or architecture of the platform
  • Create any derivative work, adaptation, or product that is substantially similar to, or based upon, the ServiceTrove platform
  • Use the platform to develop, build, or assist in building a competing or similar product or service
  • Scrape, crawl, spider, index, or use any automated means to extract, collect, or harvest any content, data, design elements, or structural information from the platform
  • Screenshot, record, or systematically capture the platform's interface, pages, or workflows for the purpose of replication
  • Hire or engage any third party to perform any of the above prohibited activities on your behalf

10.3 Trade Secrets & Proprietary Information

The platform's architecture, algorithms, business processes, pricing models, feature implementations, and technical infrastructure constitute trade secrets and confidential proprietary information of Service Trove LLC. Access to the platform does not grant you any right, license, or permission to use this proprietary information for any purpose other than using the platform as intended under these Terms.

Any unauthorized use, reproduction, or distribution of our intellectual property or trade secrets may result in immediate account termination and will subject you to civil liability for damages (including statutory damages, actual damages, and lost profits) and injunctive relief, as well as potential criminal prosecution under applicable intellectual property and computer fraud laws.

10.4 Trademarks

"ServiceTrove," "Service Trove," the ServiceTrove logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Service Trove LLC. You may not use these marks without our prior written permission. All other names, logos, and brands are the property of their respective owners.

11. Data and Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Business owners are responsible for their own compliance with applicable data protection laws regarding their clients' information.

12. Service Availability & Data Loss

Data Loss Disclaimer: While we implement commercially reasonable backup and recovery procedures, we do not guarantee that your data will never be lost, corrupted, or become inaccessible. Data loss may occur due to hardware failures, software errors, cyberattacks, natural disasters, third-party service provider failures, or other events beyond our control. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF ANY CRITICAL BUSINESS DATA. We strongly recommend that you regularly export and back up your client lists, booking records, financial data, and any other information critical to your business operations. We are not liable for any data loss, business interruption, lost revenue, or other damages resulting from data loss, regardless of cause.

13. Disclaimer of Warranties

THE SERVICETROVE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE; (C) ANY SERVICES LISTED BY USERS ARE LEGAL, SAFE, PROPERLY LICENSED, OR OF ANY PARTICULAR QUALITY; OR (D) ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.

SERVICETROVE IS A TECHNOLOGY PLATFORM ONLY. WE ARE NOT A PARTY TO ANY TRANSACTION BETWEEN USERS. WE DO NOT VERIFY, ENDORSE, OR GUARANTEE THE IDENTITY, BACKGROUND, QUALIFICATIONS, LICENSING, OR LEGITIMACY OF ANY USER OR THE SERVICES THEY OFFER. YOU USE THE PLATFORM AND INTERACT WITH OTHER USERS AT YOUR OWN RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICE TROVE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM:

  • YOUR USE OF OR INABILITY TO USE THE SERVICE
  • ANY CONDUCT, CONTENT, OR SERVICES OF ANY THIRD PARTY OR OTHER USER ON THE PLATFORM
  • ANY ILLEGAL, HARMFUL, FRAUDULENT, OR OTHERWISE OBJECTIONABLE ACTIONS BY OTHER USERS
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS
  • ANY DISPUTES BETWEEN USERS, INCLUDING BETWEEN SERVICE PROVIDERS AND THEIR CLIENTS
  • LOST BOOKINGS, MISSED APPOINTMENTS, OR LOST REVENUE RESULTING FROM PLATFORM DOWNTIME, SERVICE INTERRUPTIONS, BUGS, ERRORS, OR ANY OTHER MALFUNCTION OF THE APP OR ITS FEATURES
  • FAILED, DELAYED, OR INCORRECT PAYMENT PROCESSING, PAYOUT ERRORS, OR PAYMENT SYSTEM OUTAGES, WHETHER CAUSED BY US, STRIPE, OR ANY OTHER THIRD-PARTY PAYMENT PROVIDER
  • ERRORS IN SCHEDULING, CALENDAR AVAILABILITY, PRICING DISPLAY, OR BOOKING CONFIRMATION THAT RESULT IN FINANCIAL LOSS, CLIENT DISPUTES, OR BUSINESS DISRUPTION
  • MISSED OR UNDELIVERED NOTIFICATIONS (INCLUDING APPOINTMENT REMINDERS, BOOKING CONFIRMATIONS, OR PAYMENT ALERTS) THAT RESULT IN NO-SHOWS, LOST APPOINTMENTS, OR LOST REVENUE
  • LOSS OF CLIENTS, BUSINESS REPUTATION, OR BUSINESS OPPORTUNITIES RESULTING FROM PLATFORM UNAVAILABILITY, FEATURE DEGRADATION, OR ANY OTHER ISSUE WITH THE APP
  • ANY FINANCIAL LOSSES ARISING FROM YOUR RELIANCE ON THE PLATFORM FOR CRITICAL BUSINESS OPERATIONS, INCLUDING WHERE THE PLATFORM EXPERIENCES OUTAGES, DATA LOSS, OR ERRORS DURING HIGH-DEMAND PERIODS

SERVICETROVE IS A SOFTWARE TOOL TO ASSIST YOUR BUSINESS — IT IS NOT A GUARANTOR OF YOUR BUSINESS OUTCOMES. We make no guarantee that use of the platform will result in any particular level of bookings, revenue, client retention, or business growth. All business and financial decisions made in reliance on the platform are made at your own risk.

Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. In no event shall our total cumulative liability to you exceed $500 USD, even if we have been advised of the possibility of such damages.

15. Indemnification

You agree to defend, indemnify, and hold harmless Service Trove LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of the service or any activity under your account
  • Your violation of these Terms
  • Your violation of any applicable law, regulation, or third-party rights
  • Any content or services you post, list, or offer through the platform
  • Any illegal, fraudulent, harmful, or unauthorized activity conducted through your account
  • Any claim by a third party related to the services you provide or interactions facilitated through the platform
  • Your failure to obtain required licenses, permits, or insurance for your services

16. Termination

We may suspend or terminate your account immediately, without prior notice or liability, if:

  • You violate these Terms or any applicable law
  • We reasonably suspect illegal, fraudulent, or harmful activity
  • We receive a valid legal request or court order
  • Your account poses a safety or security risk to the platform or other users
  • For any other reason at our sole discretion

Upon termination, your right to use the service ceases immediately. We may retain your account data as necessary to comply with legal obligations, resolve disputes, enforce our agreements, or cooperate with law enforcement. Termination does not relieve you of obligations incurred prior to termination, including indemnification obligations.

If your account is terminated for suspected illegal activity, we reserve the right to report the activity and disclose relevant account information to law enforcement.

17. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Service Trove LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, and not through court proceedings, except for claims that may be brought in small claims court.

CLASS ACTION WAIVER: YOU AND SERVICE TROVE LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

18. No Agency Relationship

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Service Trove LLC. ServiceTrove is a platform that facilitates connections between service providers and clients. We are not a party to any transaction between users and bear no responsibility for the actions, omissions, quality, legality, or safety of any services offered by users.

19. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the platform. Your continued use after changes become effective constitutes acceptance of the new Terms.

20. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.

21. General Provisions

  • Force Majeure: We are not liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, pandemics, government actions, power outages, internet outages, cyberattacks, or failures of third-party service providers
  • Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable
  • Entire Agreement: These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Service Trove LLC regarding your use of the platform, superseding all prior agreements, understandings, and communications
  • Assignment: We may assign or transfer these Terms, in whole or in part, without restriction and without notice. You may not assign or transfer your rights or obligations under these Terms without our prior written consent
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision shall be effective only if in writing and signed by us
  • Notices: We may provide notices to you via email to the address associated with your account, through the platform interface, or by posting on the platform. You are responsible for keeping your contact information current. Notices sent by email are deemed received on the date sent. For legal notices to us, send to legal@servicetrove.com
  • Headings: Section headings are for convenience only and have no legal or contractual effect
  • Survival: Sections relating to intellectual property, limitation of liability, indemnification, dispute resolution, and any other provisions that by their nature should survive termination shall survive the expiration or termination of these Terms
